The present observatory has as objective to deepen the scientific investigation concerning an actual and important problematic. It is the "Trans national Insolvency". In this study we intend to approach subjects as: the international competence, the determination of the applicable law and the recognition in a State of a sentence emitted in other, whenever, due to the circumstances (situations in which there are connections with more than a juridical ordinance - "international failure"), be necessary the analysis of these subjects. The newness of the theme is emphasized by the publication of the Communitarian Regulation relative to the insolvency processes (no. 1346/2000, of the Council of May 29), that will go into effect May 31, 2002.
